Taxi & Private Hire – General Terms & Conditions

AIRPORTDRIVER TAXI provides services on the basis of the following terms and conditions, service descriptions and price lists. Conflicting terms and conditions do not apply, even if AIRPORTDRIVER TAXI does not expressly object to them. Deviations from these conditions require the express written acknowledgement of AIRPORTDRIVER TAXI. A contract is only concluded when confirmed by AIRPORTDRIVER TAXI.

Scope of Services

The scope of services is determined exclusively by the written order confirmation of AIRPORTDRIVER TAXI or, subsidiarily, by the written offer of AIRPORTDRIVER TAXI. Information contained in brochures, service catalogues, price lists and similar materials is only binding to the extent that express reference is made to it. Transport is carried out in accordance with the provisions of the Highway Code (StVO) and the Passenger Transport Act (PbefG). Passengers must comply with instructions from AIRPORTDRIVER TAXI or the chauffeur. If guests act contrary to instructions or create a hazard under the StVO or to road safety by impairing the chauffeur, AIRPORTDRIVER TAXI is entitled to exclude them from transport. In this case AIRPORTDRIVER TAXI charges the full fare including fixed price or per-kilometre price and all ancillary and special services.

Airport Pick-up (Airport Transfer)

Any change to the agreed pick-up time, for whatever reason, must be communicated to AIRPORTDRIVER TAXI without delay. Damages resulting from failure to notify promptly shall be borne by the customer. The AIRPORTDRIVER TAXI chauffeur will be ready at the agreed pick-up time at the respective meeting point of the airport terminal, or at the previously agreed meeting point, with a name sign or company logo, and will wait up to 60 minutes without additional charge. If no contact with the passenger or customer has been made after the 60-minute waiting period, the chauffeur will return to Vienna without a passenger. The service of AIRPORTDRIVER TAXI is then deemed to have been rendered and the full fare becomes due for payment.

Prices

Prices include statutory VAT at the applicable rate. The prices valid on the day of booking confirmation apply. Flat-rate prices not listed in the price list can only be agreed in writing and are only valid for the agreed journey date and hire period. Additional costs due to delays shall be borne by the customer, unless the delays are attributable to fault on the part of AIRPORTDRIVER TAXI or the chauffeur. The fare includes the transport of persons with normal luggage; the carriage of bulky goods requires a separate agreement.

Payment Terms

AIRPORTDRIVER TAXI reserves the right to require a deposit of up to 50% of the total price before the journey commences, or to require a blank debit authorisation of a valid credit card made out to AIRPORTDRIVER TAXI before accepting an order. Remaining payments are due within the deadlines stated on the invoice. If the customer is in default of payment, AIRPORTDRIVER TAXI charges interest at the rate of 5 percentage points above the base interest rate. For the second and each subsequent reminder, a reminder fee of €10.00 will be charged.

Cancellations and Withdrawal

Cancellations are only effective if made in writing or, if made verbally, confirmed in writing by AIRPORTDRIVER TAXI. Cancellations up to and including 24 hours before the contractually agreed start of the journey are free of charge. For cancellations, AIRPORTDRIVER TAXI charges a proportion of the basic journey price as compensation for damages:

Obligations and Liability of the Customer

The customer shall notify AIRPORTDRIVER TAXI without delay of any change to their name, address, legal form and bank details. The customer undertakes not to use the services of AIRPORTDRIVER TAXI in an abusive manner, in particular:

Liability of AIRPORTDRIVER TAXI

AIRPORTDRIVER TAXI is only liable to the customer for damages in cases of intent or gross negligence, as well as culpable breach of essential contractual obligations. In the case of property damage, liability is limited to €1,000.00 per passenger. AIRPORTDRIVER TAXI is not liable for missed appointments and their economic consequences, insofar as these were not caused by AIRPORTDRIVER TAXI (e.g. traffic jams, road closures, vehicle breakdowns, adverse weather conditions).

Applicable Law and Jurisdiction

Austrian law exclusively governs all legal relationships between AIRPORTDRIVER TAXI and its customers. The place of jurisdiction and performance is Vienna.

Severability

Should one or more of the foregoing conditions be invalid, the remaining conditions shall be unaffected by the invalidity. Invalid clauses shall be replaced by the statutory provisions.
